Introduction
This course illustrates the use of the 1999 FIDIC Conditions of Contract for Construction (the ‘Red Book’) and the FIDIC Conditions of Contract for Plant and Design-Build (the ‘Yellow Book’). The course is designed to give attendees confidence in working with these contracts, whether representing employers, consultants, or contractors. To ensure that attendees get the most out of the course, they will also have the opportunity to review case studies based on real-life situations to help them understand the correct practical application of the FIDIC clauses.

DAY 1
Module 1: Introduction to the FIDIC Organisation
This short module contains background to the FIDIC organisation, its history, structure, its services and how it operates. FIDIC user guides and additional resources are also overviewed here.
Module 2: Introduction to the FIDIC Forms of Contract
This module discusses the various forms of contract in common use internationally; namely, the Red, Yellow, Silver, Gold, Green and White Books. Correct selection and use for different types of project are also discussed. Elements of a contact, standard and bespoke contracts, are discussed, as are the contents of a typical FIDIC contract. Finally, the allocation of risk for the different forms of contract is compared.
Module 3: General Provisions of the FIDIC Forms of Contract
The General Provisions are examined and explained including definitions, communications, law and language, priority of documents, delay drawings or instructions and errors in the Employer’s requirements.
Module 4: Obligations and Responsibilities of the Main Parties
The Employer, the Engineer and the Contractor’s obligations and responsibilities are examined and explained.
Module 5: Management of Projects
This module discusses nominated subcontractors, design under the Yellow Book, staff and labour, plant materials and workmanship.
DAY 2
Module 6 – Commencement, Delays and Completion
Time related issues are examined in this module, including commencement delays and suspension, tests on completion, Employer’s taking over, defects liability and tests after completion under the Yellow Book.
Module 7 – Financial Matters
Measurement and evaluation under the Red Book, variations and adjustments and contract price and payment are examined in this module.
Module 8 – Termination and Suspension
This module examines termination and suspension by both the Employer and the Contractor.
Module 9 – Risk, Liability and Force Majeure
Risk and responsibility, liability and insurance and force majeure are discussed and examined in this module.
Module 10 – Claims, Disputes and Arbitration
The final module covers contractor’s claims the dispute adjudication board, amicable settlement and arbitration.
